Service Terms and Conditions for Waste Clearance Ealing

1. Definitions

In these Terms and Conditions, the following words have the meanings set out below:

Client, you, your: The person, company, or organisation requesting or paying for the services.

Company, we, us, our: Waste Clearance Ealing, the provider of the services.

Services: Any waste removal, collection, transport, disposal, or related services provided by the Company, including loading, lifting, and clearance work.

Waste: Any items, materials, rubbish, refuse, furniture, appliances, or other goods presented to us for collection and disposal.

Booking: A confirmed arrangement for the Company to provide services at a specified time, date, and location.

Site: The property or location where the services are to be carried out.

2. Scope of Services

We provide waste clearance and collection services for domestic, commercial, and other clients within our operational area. The exact nature and scope of the services will be as agreed at the time of booking or as specified in our quotation or confirmation.

Our services generally include the loading of waste onto our vehicle, reasonable labour for lifting and carrying, and transport of the waste for lawful disposal or recycling. Any additional services, such as dismantling, disconnection of appliances, or work at height, must be expressly agreed in advance and may be subject to additional charges and safety conditions.

3. Booking Process

3.1 Bookings can be made by telephone, email, or through any other communication channels we may offer. When you provide details of the waste and the Site, you confirm that the information is accurate and complete to the best of your knowledge.

3.2 We may provide an estimate based on your description of the waste volume, type, access conditions, parking arrangements, and any special requirements. Such estimates are given in good faith but are not binding until our operatives have inspected the waste at the Site.

3.3 Upon arrival at the Site, we will assess the waste and confirm the final price before commencing work. If the quantity or type of waste or the access conditions differ significantly from those described at the time of booking, we reserve the right to amend the price or refuse the job.

3.4 A booking is only confirmed when we have agreed the date and time window for collection and, where applicable, any deposit or advance payment has been received.

3.5 We will use reasonable efforts to attend the Site within the agreed time window, but times are approximate and subject to traffic, previous jobs, and other factors outside our control. We accept no liability for delays but will keep you informed where reasonably possible.

4. Access, Parking, and Site Conditions

4.1 You are responsible for ensuring safe and reasonable access to the Site, including clear pathways for our staff and vehicle. If the Site is not easily accessible, this may affect the price and the feasibility of completing the job.

4.2 You must ensure that suitable parking is available for our vehicle near the Site. Any parking charges, permits, or fines incurred as a result of inaccurate information or failure to provide adequate parking details may be charged to you.

4.3 We reserve the right to refuse or suspend services if Site conditions are, in our reasonable opinion, unsafe, unlawful, or likely to cause damage to property or injury to persons. In such circumstances, a call-out or cancellation fee may apply.

5. Waste Types and Regulations

5.1 We operate in accordance with applicable UK waste management legislation and regulations, including the duty of care for controlled waste and relevant environmental protection laws.

5.2 You are responsible for informing us in advance of any hazardous or specialist waste. Hazardous waste may include, but is not limited to, asbestos, chemicals, solvents, paints, oils, gas cylinders, clinical waste, and electrical items requiring special handling.

5.3 We may be unable to remove certain waste types due to legal, safety, or licensing restrictions. If we discover such items at the time of collection which were not disclosed in advance, we may refuse to collect them, charge additional fees for safe handling, or cancel the service.

5.4 By presenting waste for collection, you confirm that you either own the waste or have full authority from the owner to dispose of it. You agree to indemnify us against any claims arising from our removal of items that you did not have the right to dispose of.

5.5 Once collected, the waste becomes our responsibility, and we will transport it for reuse, recycling, or disposal at authorised facilities in compliance with applicable regulations.

6. Pricing, Quotations, and Estimates

6.1 Prices are generally based on the volume, weight, type of waste, labour required, access conditions, and any additional services requested. We may also apply minimum charges for small loads.

6.2 Any quotation or estimate provided before inspection of the waste is indicative only and subject to confirmation by our operatives at the Site. Where the actual waste differs from your original description, the final price may be higher or lower than the estimate.

6.3 All prices are quoted in pounds sterling and may be inclusive or exclusive of VAT, depending on the status of the Company. This will be made clear at the time of quotation.

6.4 We reserve the right to modify our pricing structure at any time. Changes will not affect bookings that have already been confirmed, except where the nature or volume of waste has been misrepresented.

7. Payments and Invoicing

7.1 Payment is normally due on completion of the services, unless otherwise agreed in writing. We accept various payment methods, which will be communicated at the time of booking.

7.2 For commercial clients, or where account facilities have been agreed, we may issue an invoice payable within a specified period. Late payments may incur interest or administrative charges in accordance with applicable legislation on late payment of commercial debts.

7.3 If payment is not made when due, we reserve the right to suspend further services and to take appropriate steps to recover outstanding sums, including the use of debt recovery agencies where necessary.

7.4 You must notify us without delay if you believe any invoice or charge is incorrect. We will investigate and rectify any errors that we confirm as valid. Disputes over specific charges do not entitle you to withhold payment of undisputed amounts.

8. Cancellations and Amendments

8.1 You may cancel or reschedule a booking by giving us reasonable notice. We request that any changes be made as early as possible so we can manage our schedule efficiently.

8.2 We reserve the right to apply a cancellation fee if you cancel or significantly amend a booking with insufficient notice, or if our operatives are unable to carry out the work on arrival due to circumstances within your control, such as lack of access, no one on Site where required, or incorrect information about the waste.

8.3 If we need to cancel or reschedule a booking due to operational issues, staff availability, vehicle breakdown, safety concerns, or other reasons, we will notify you as soon as reasonably possible and offer an alternative date or time. We are not liable for any indirect or consequential losses arising from such changes, but any payment made for services not delivered will be refunded where appropriate.

9. Client Responsibilities

9.1 You are responsible for providing accurate information about the waste, including its type, quantity, and any special handling requirements. Misrepresentation may lead to additional charges or refusal of service.

9.2 You must ensure that any items you wish to keep are clearly separated from the waste to be removed. Our operatives are not responsible for identifying which items should or should not be taken.

9.3 You must ensure that all children, pets, and unauthorised persons are kept away from the working area while our operatives are on Site. You agree to follow any safety instructions given by our staff.

9.4 Where necessary, you are responsible for obtaining any consents, permits, or approvals from landlords, managing agents, local authorities, or other third parties to enable us to carry out the services.

10. Our Responsibilities and Limitations of Liability

10.1 We will provide the services with reasonable care and skill, consistent with good industry practice and applicable regulations for waste management in the UK.

10.2 We carry appropriate insurance for our operations. Details of our cover are available on request. Our liability to you is limited to the level of our insurance coverage, except where the law does not allow such limitation.

10.3 We are not liable for any loss or damage arising from circumstances beyond our reasonable control, including but not limited to adverse weather, traffic delays, mechanical breakdowns, or industrial action.

10.4 We are not responsible for any loss of profits, loss of business, business interruption, loss of opportunity, or any indirect or consequential losses arising out of or in connection with our services.

10.5 You must notify us of any visible damage allegedly caused by our operatives at the Site before they leave, or as soon as reasonably practicable thereafter. We may need to inspect the damage and the Site before accepting liability.

10.6 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

11. Ownership of Items and Disposal

11.1 By presenting items as waste, you confirm that they are no longer required and that we may remove, reuse, recycle, or dispose of them at our discretion, subject to legal and regulatory requirements.

11.2 Once removed from the Site, waste items cannot normally be retrieved. If you later claim that items were removed in error, we will attempt to assist, but we do not guarantee that the items can be recovered.

11.3 We may separate items for recycling or reuse as part of our commitment to responsible waste management. This does not entitle you to any discount, rebate, or share in any proceeds obtained from such activities.

12. Complaints and Disputes

12.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as possible with full details of your complaint. We take all feedback seriously and will aim to resolve issues promptly and fairly.

12.2 Where a dispute cannot be resolved directly between you and us, either party may consider using an independent mediation or dispute resolution service, where available and appropriate.

13. Data Protection and Privacy

13.1 In the course of providing services, we may collect personal data from you, such as your name, contact details, and service address. We will handle such data in accordance with applicable data protection laws in the UK.

13.2 We use your information to manage bookings, provide services, issue invoices, and communicate with you about our operations. We may also retain records for legal, accounting, and regulatory purposes for a reasonable retention period.

13.3 We do not sell your personal data to third parties. We may share limited information with trusted service providers or authorities where necessary to deliver our services or comply with legal obligations.

14. Variations to These Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our business practices, or the services we offer.

14.2 The version of the Terms and Conditions that applies to your booking will be the version in force at the time you make the booking, unless a change is required by law or regulation.

15. Severability

15.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful, or unenforceable, that provision will be deemed removed, and the remaining provisions will continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any disputes or claims arising out of or in connection with them or the services provided are governed by and construed in accordance with the laws of England and Wales.

16.2 You and the Company agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation, booking confirmation, or additional terms expressly agreed in writing, constitute the entire agreement between you and the Company regarding the provision of waste clearance and collection services.

17.2 You acknowledge that you have not relied on any statement, promise, or representation not expressly set out in these Terms and Conditions or in a written agreement signed on behalf of the Company.

By proceeding with a booking or allowing our operatives to commence work, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
